Welcome to BRIJ, a U.S.-based platform that connects users to Solana's ecosystem through an API-first on-ramp aggregator for fiat-to-crypto conversions. By accessing or using our services, website (brij.fi), APIs, or related tools (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. You must also agree to the Terms of Use of third-party on-ramp providers when using their services. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By using the Services, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. BRIJ reserves the right to modify these Terms, with changes posted on brij.fi. Continued use of the Services after changes constitutes acceptance of the updated Terms.

2. Description of Services

BRIJ provides an API-first platform that aggregates third-party on-ramp providers (e.g., MoonPay, Ramp) to facilitate fiat-to-crypto conversions (e.g., USD to SOL or USDC) within the Solana ecosystem. The Services include:

• Integration with Solana-based applications (e.g., dApps, wallets, NFT marketplaces).
• User-sovereign data storage, where all data (including email and transaction metadata) is encrypted and stored in decentralized, non-immutable storage, with read-only access controlled by your private key.
• Real-time analytics and compliance reports via a dashboard.

BRIJ does not directly process payments, perform KYC verifications, or custody crypto assets. These functions are handled by third-party on-ramp providers, who operate under their own Terms of Use.

3. User Responsibilities

Account and Private Key Security

You are responsible for maintaining the security of your account credentials and private key, which controls read-only access to your encrypted data (including email and transaction metadata). BRIJ is not liable for any loss or damage resulting from unauthorized access due to your failure to secure your key.

Explicit Consent

By using the Services, you explicitly consent to share sensitive data (e.g., email, transaction details) with third-party on-ramp providers for payment processing, KYC verification, and fraud detection. You must agree to their Terms of Use during the transaction process.

Compliance

You agree to use the Services in compliance with all applicable laws, including the U.S. Bank Secrecy Act (BSA) and, if applicable, the EU General Data Protection Regulation (GDPR).

Prohibited Activities

You may not use the Services to:

• Engage in illegal activities, including money laundering or fraud.
• Attempt to bypass security measures or interfere with the Services.
• Use the Services for purposes other than fiat-to-crypto conversions within the Solana ecosystem.

4. Third-Party On-Ramp Providers

BRIJ partners with third-party on-ramp providers to process fiat payments, KYC verifications, and fraud detection. You will be prompted to accept their Terms of Use and Privacy Policies, which govern their processing of your personal data (e.g., email, KYC, payment information).

BRIJ shares sensitive data (e.g., email, transaction details) with providers, accessible in read-only mode via your private key, only with your explicit consent.

BRIJ is not responsible for the actions, policies, or performance of third-party providers. Review their Terms of Use and Privacy Policies before proceeding.

5. Data Privacy

BRIJ prioritizes user sovereignty by encrypting and storing all data (including email and transaction metadata) in decentralized, non-immutable storage, accessible only via your private key. As a data controller, BRIJ collects and processes sensitive data to facilitate transactions and prevent fraud. 6. Intellectual Property

All content, trademarks, and technology related to the Services are the property of BRIJ or its licensors. You may not copy, modify, or distribute any part of the Services without prior written consent from BRIJ.

7. Limitation of Liability

To the fullest extent permitted by law, BRIJ is not liable for any indirect, incidental, or consequential damages arising from your use of the Services, including loss of funds, data, or access to the Solana ecosystem. The Services are provided "as is" without warranties of any kind.

8. Termination

BRIJ may suspend or terminate your access to the Services at its discretion, including for violation of these Terms or suspected illegal activity. Upon termination, your right to use the Services ceases, but data retention obligations (as outlined in the Privacy Policy) may persist.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts of Delaware.
